Acceptable Use Policy

This document pertains to the rules and regulations that are required to be followed at all times by the customer, herein referred to as 'customer', and iHost Technologies, herein referred to as 'provider'. All perspective customers are required to sign this document before account is processed, and before any work is begun on creating accounts or accessibility on any systems by the provider.

If the customer has any more questions, or wishes to check for rules or amendments this document, they may access http://www.ihosttech.com/docs/aup.html. This is subject to network and server status. Any other questions may be forwarded via e-mail to aup@ihosttech.com. The provider reserves the right to amend this document at any time without warning or notification.

In the event any customer or authorized personnel for the account does not follow any of the rules outlined in this AUP, the provider reserves the right to terminate customer's services without warning, and without refund of remaining account balance. Any actions undertaken by the customer that directly or indirectly causes the provider, or any of its other customers degraded performance, or loss of data and/or information, may result in legal action against the customer. If at any time, the provider believes the customer has broken any Canadian laws using or involving their service with the provider, the account will be terminated immediately without warning or refund.

The provider will happily provide any local, provincial, or federal authority with logs, and personal information of any customer believed to have broken any Canadian laws directly involving the customer's service with the provider.

Limited Liability

The provider does not assume any responsibility for damages suffered by any person or entity as a result of lost data, non-delivery, interruptions, or failures in service, even if caused by negligence or omissions on the part of the provider or any other party. The provider may terminate service at any time without reason by refunding remaining balance to the customer. Non-corporate customers may not use their site, e-mail accounts, or any other service with the provider for anything other than personal use, and cannot hold the provider responsible for lost revenues in the event of any interruptions. Users who cancel their accounts will not be refunded the remainder of their account balance.

Limited Liability : Secure Socket Layer (SSL)

The provider can at no time be held for responsible for compromised data within our SSL. Our Shared SSL and Hosted SSL services only provide encryption any use that may contain private or secure sensitive information is at the risk of the client.

Backups

The provider is not responsible for customer's backups or data. In the event of hardware failure, or any other mishap, whether caused by negligence on the provider's fault, or otherwise, all backing up is the responsibility of the customer, and the provider cannot be held liable for missing or corrupted data.

Electronic Mail

The provider cannot guarantee e-mail will arrive to its destination mailbox unaltered, and unread, as the e-mail protocol is generally an insecure one. The provider is not responsible for any e-mail that goes missing in transit, or gets deleted for any reason whatsoever. E-mail will not be deleted off of the provider's systems unless the user requests it, the user deletes it, or if it exceeds 5MB in size. The provider will provide the customer with one month of free e-mail forwarding after the customer's contract with the provider is terminated, assuming the customer provides a new e-mail address to forward to, and the contract is terminated for a legitimate reason.

The customer agrees that iHOST Technologies can discontinue any accounts being used for spamming. This conclusion is derived from at least 3 complaints regarding being spammed. SPAMMING under iHOST Technologies services will be penalized with a $500.00 Canadian funds SPAM CLEAN UP fee. This fee is non-negotiable and is to cover all costs of cleaning pop boxes and time spent removing our servers net-block from black lists due to spamming.

Spam monitoring and warnings are not provided. If these complaints should reach iHOST Technologies then the client has not taken the requests from SPAM victims seriously and has continued to use our services in a unlawful manner. iHOST considers this one of the most serious offenses to be committed on our systems. iHOST does not and will not tolerate SPAM.

User Terms

The customer may not use the provider's services to directly or indirectly obstruct any federal, provincial, or municipal laws. The customer may not use the provider's services to take part in any mail bombs, mass e-mailing, or bulk mail activities. The customer may not use the provider's service to take part in any Denial of Service (DoS) attacks, or port scans of any systems on any network, whether local, or global. The customer is responsible for all material available on their web page, and may not use their space for provision of illegal software, hate material, or pornography. The data must be suitable for all ages, and is subject to discretion by any of the provider's employees as to what is acceptable and what is not. Any users which appear to have any illegal or improper data on their pages will have their accounts terminated without notice or refund.

NSF cheques carry a $25.00 fee for administration. All accounts must be prepaid by three months. If payment is not received within 90 days of renewal, then a setup fee may be incurred again to bring the account back to its original status.

The provider reserves the right to terminate the users' account without refund for any reason whatsoever if it is in the providers' best interest, whether outlined or not in this document.

iHOST Technologies reserves the right to modify this document at anytime. By signing-up and paying for iHOST Technologies services you (the client or customer) agree to the above terms.
